Article 1 Shop Operator ("Seller")

Article 2 Prices, Fees, Shipping, Delivery Time, VAT, Payment Options, EET, Manuals

I. Shipping and delivery surcharge prices will be displayed on the checkout page. Just add anything to your cart and go to checkout and choose the country of delivery. When you place your order, you will also receive the shipping and delivery surcharge prices in your order confirmation email. For some countries we only accept payment in advance.

II. Transportation for virgins and for heavier goods, for which we indicate this on the product page, can only be selected by the transport method marked "Sex doll transport". If this shipping method is not available for your country, we do not ship heavier loads there as standard and the price must be agreed individually via email.

III. When making a non-cash payment, the Seller always pays the fees of his bank and does not pay the fees of the Buyer's bank (especially for foreign payments). The Seller's telephone line (or email) does not involve a special charge; the caller pays the price according to his operator's price list for calls to the Czech Republic.

IV. For purchases of goods up to 110CZK, only pickup in store or shipping is possible only with prepayment.

V. The Stone Shop accepts cash in Czech crowns. Payment outside the shop or in other currencies is possible only according to the seller's instructions (see Contact). For cash payments at the shop, the following applies: according to the Sales Records Act, the seller is obliged to issue a receipt to the buyer. At the same time, the seller is obliged to register the sales received with the tax authorities online; in case of technical failure, within 48 hours at the latest.

VI. Payment by bank transfer and credit card is possible in any permitted currency of the store. Payment by cash on delivery and by card is only possible in the currency of the country of delivery.

Article 3 Personal data

I. Customer and purchase data is confidential and protected in accordance with the requirements of EU GDPR 679/2016. Your data is only used to process your order and is only passed on to your chosen carrier. We delete them irreversibly after 2 months after the order has been processed. For further mandatory data protection information, please see Privacy.

II. The customer grants the shop operator a subsequent power of attorney. On behalf of the customer, the shop operator may request the deletion of the customer's personal data from a third party that the shop operator has passed on to a 3rd party, e.g. a carrier (except for data that the 3rd party is obliged to retain by law). Specifically, the email, telephone, address and contact details of the customer with the shop operator in the 3rd party's database. This power of attorney serves in particular for the situation where the 3rd party resists the deletion of customer data on the basis of a request from the shop operator.

Article 4 Complaints Procedure and Defects Warranty

I. The warranty for the purchased goods is 2 years. For sale items on display, the product description may be reduced to a year. For goods purchased on a business owner's company, the warranty is 6 months (with the company or business ID added to the billing information). For the professional discount, the warranty and liability for defects given by this discount program apply (see FAQ). The Seller is liable for the conformity of the goods with the contract and for defects in the goods during the warranty period, except for defects resulting from use and care contrary to the instructions or in a manifestly unreasonable manner.

II. Before sending it is advisable to contact the seller to make a complaint, as complaints can sometimes be resolved more quickly by simply sending the seller the missing or defective part. The buyer sends the goods for complaint Art. 8 with a description of the defects and a contact address. Providing an email or phone number can significantly speed up the complaint process. Upon personal delivery, the seller will issue a complaint report. Complaints are dealt with as quickly as possible, otherwise within 30 days.

III. If the defect cannot be remedied, if the same defect recurs, the buyer may, in addition to the repair, request replacement of the item, withdraw from the contract or request a reasonable discount. When the item or component is replaced, the entire warranty period of the item or component starts from the beginning. In the event of a justified claim, we will also pay the reasonable costs of transporting the item to and from the claim (postage).

IV. In the event of an unjustified claim, the consumer shall only bear the costs of returning the goods to the extent of the costs of return to the return address for the country to which the parcel was originally delivered (see below). The cost of re-shipment of the goods in the event of an unjustified claim shall be borne by the consumer in accordance with the seller's transport tariff. The Buyer shall pay the costs incurred in returning and re-shipping the goods wrongfully claimed in advance to the Seller's account within 3 months of notification of rejection of the claim. Otherwise, the buyer shall be deemed to have abandoned the item and the item shall be discarded as unsaleable for hygiene reasons due to its nature, unless it is a whole item that can be sterilised or an appliance that is not being reinstalled.

Article 5 Distance contracts (online purchase)

I. A consumer is a natural person who has not added his/her company name or ID number to the order or billing information.

II. Electronic order: add to cart button, choice of delivery and payment method, order button. We do not take telephone orders.

III. The contract for the goods available in stock is concluded upon confirmation of acceptance of your order by our system. For orders over EUR 300 on delivery, the seller may request a deposit within 3 days. In this case, the contract is only concluded upon receipt of the deposit.

IV. The contract for the virgins is concluded by paying at least half of the purchase price in advance and email confirmation of the individual specifications of the virgin by the buyer.

V. For other non-stock goods, the contract is concluded by confirmation of the buyer upon receipt of information on availability, in the case of a required advance payment only by payment of the advance.

VI. The consumer may cancel (by phone or email) the order of a distance contract free of charge until the seller has notified the carrier of the shipping data, except for goods made at the customer's request (e.g. sex doll).

VII. Upon receipt of the goods from the carrier, the buyer shall check the integrity of the packaging. In case of damage to the packaging or suspicion of unauthorized opening of the order, the buyer may refuse to accept the order, or first record the damage and then open and inspect the shipment together with the carrier.

VIII. If a customer in a brick-and-mortar shop holds in his hand the goods of an order not yet completed and the goods are bought in the meantime by an internet customer, Priority has an online customer (legally placed the order earlier). For goods where the purchase contract is conditional on a deposit or the possibility to request it, this applies only at the moment of crediting the proper deposit to our account.

IX. The Seller may cancel the reservation or withdraw from the contract without delay by email if the deposit or the price of the goods is not paid in advance after the expiry of the electronic payment option 24 hours calculated in working days only when ordering from the Czech Republic or after the expiration of 48 hours calculated in working days only when ordering from Europe. Seller may refuse an order from a problematic IP address or with false or unlikely billing and contact information.

X. The Seller may reject the order or withdraw from the contract without delay by email in the event of theft, deterioration or defect of the goods, and in the case of goods on order, in the event of failure of the supplier or carrier, and shall immediately inform the Buyer of the reason and immediately return the funds received. Furthermore, due to an apparent error in the price in orders or currencies or number of units at a given price and warehouse error, where we do not physically have the goods.

XI. When collecting prepaid goods from the shop, the person collecting may be asked to provide proof of identity or otherwise prove his/her status.

XII. The Seller may require payment in advance:

a) for goods available only on order.

b) if the customer has not collected the previous order on delivery.

Article 6 Withdrawal of the consumer from a distance contract

I. The consumer may withdraw from the purchase without giving any reason under the conditions set out below. Withdrawal effective upon dispatch may be exercised within a period of 14 days, starting from the day following the date of delivery of the goods, by means of the form below or by similar intelligible written communication.

II. With the exception of all-metal objects without cavities, clothing, handcuffs outside the genital area and devices that are not introduced, the contract cannot be withdrawn in this way after the goods have been used or after the hygienic packaging or seal has been opened, nor can the contract for the purchase of goods that cannot be returned for hygienic reasons. These are in particular goods for contact with the internal private parts of the body, e.g. vibrators, dildos, gags (gags), virgins, open gels, panties, chastity belts). Also BDSM goods that trap human tissue when used (canes, whips), latex. For these goods, sanitary packaging means any packaging or seal that must be irreversibly broken to access the goods (usually welded, taped or sealed plastic or boxed packaging).

III. Irrespective of the breach of the hygienic packaging, the purchase of custom-made goods or non-stock goods marked "made to order" cannot be withdrawn in this way at all. These are hard-to-sell and generally unrecommended goods which the seller would sell at a loss. The consumer is aware that the goods are in practice only saleable directly to him and agrees to the arrangement that the goods cannot be returned in this case without justification. The consumer does not perceive this arrangement to his disadvantage, otherwise the goods could not have been ordered and delivered at all.

IV. The goods must not show signs of damage or wear. If the packaging or accessories are missing or damaged beyond what is reasonably necessary for gentle opening, the Seller may reduce the amount returned accordingly.

V. The goods must be dispatched or delivered within 14 days of sending the withdrawal, otherwise the buyer is deemed to have cancelled the withdrawal. If you are sending the goods separately from the withdrawal, identify them with your name or sales receipt number or a copy thereof. Goods sent COD will not be accepted.

VI. The consumer shall be entitled to a refund of the price of the goods in the manner in which they were paid for, within 10 days of the return of the goods that can be returned (see paragraphs 6. II. - IV. above). In the event of withdrawal within 14 days, the consumer shall bear the cost of delivery at the time of purchase, including any cash on delivery fee.

VII. The cost of returning the goods shall be borne by the consumer only to the extent of the cost of return to the return address for the country to which the parcel was originally delivered (see below). If there is no such address for that country, all return costs shall be borne by the seller. If the cost of delivery to the Consumer is included in the price of the goods (free shipping), the Seller shall refund everything received from the Consumer including the cost of delivery to the Consumer.

VIII. Upon receipt and return of payment, you only pay your bank's transaction fee, if any, on your account. If the Consumer pays in cash on delivery and does not provide a bank account for the refund, the Consumer will bear the costs associated with the return of this payment according to the price list of the service provider delivering the cash (Czech Post for the Czech Republic, for other countries westernunion.com).

IX. If the conditions for withdrawal are not met, the Seller shall inform the Buyer thereof. The item can be picked up at the shop or sent after the buyer has paid the shipping fee within 3 months from the notification. Later, the owner is deemed to have abandoned the item and the item is discarded as unsaleable due to its nature for hygienic reasons.

Article 9 Supplementary provisions

I. Legal relations arising from the purchase contract and other possible legal relations between the operator of the shop and the buyer or customer are governed by these terms and conditions, in matters not covered by these terms and conditions, by Czech law and EU regulations.

II. The District Court for Prague 4 or the Municipal Court in Prague in the Czech Republic is competent for the judicial settlement of disputes arising from the purchase contract and other possible legal relations between the shop operator and the buyer or customer.

III. For the out-of-court settlement of consumer disputes is competent at the level of:
